The type of design control system and the precise details of implementation are left for each firm to decide based on the complexity and risks associated with their devices. If design control requirements are applicable to the operations of the firm, select a design project.
Essentially, the Model Audit Rule is the insurance industry’s regulatory counterpart to the Sarbanes-Oxley Act of 2002 (SOX) for private insurers.
Design control begins with development and approval of design inputs, and includes the design of a device and the associated manufacturing processes. Design control does not end with the transfer of a design to production.
Materiality and annual risk assessments should drive the MAR program’s overall scope and plan. Ensuring that a formalized risk assessment is completed annually by obtaining business owner and management input is key to ensuring that internal audit is testing/focusing on the appropriate key areas.
However, New York did not adopt the Model Audit Rule and rather has passed similar requirements through Regulation 118. Regulation 118 does not allow a two year grace period unless the threshold is breached through a business combination or acquisition.
Model laws and guidelines are an important part of the national system of state-based insurance regulation. The model laws, when coupled with the NAIC Accreditation process, address areas where uniformity and consistency across state borders is beneficial to all.
The NAIC group must have approval of the parent committee and the Executive (EX) Committee before devoting resources to the development or drafting of a model law, unless the model is mandated by federal law or required for consistency or compliance with federal law.
