When end-clients determine the IR35 status of contractors in the private sector from April 2021 onwards, they are tasked with taking ‘reasonable care’ when making employment status decisions.
IR35 v. Off-payroll Chapter 8 provides the details for when the assessment is made by the contractor, so applies up to 6 April 2021 in the private sector and will apply after 6 April 2021 for when the client is a small business.
And despite HMRC themselves stating that blanket assessments are not compliant, the tax office has done very little – if anything – to stop them being made in the public sector. It’s widely acknowledged that The NHS, among other public sector bodies, took this approach when managing IR35 reform.
If the PSC believed that they were operating ‘inside IR35’, they would pay tax as if they were an employee but, would have no equivalent employment rights. This legislation has been largely unsuccessful in achieving the aims HMRC had desired.
